As you are aware there have been Federal Agents from ICE and Board Patrol actively policing cities in North Carolina including Asheville. In light of this, the association leadership wanted to make you aware that the  National Apartment Association has created Member Resources for Immigration Enforcement and Rental Housing, these resources can be found on the AAWNC website:

None of the following constitutes legal advice, and property owners or managers should always consult their legal team to determine appropriate risk tolerances and understand potential liabilities.

If federal immigration agents request access to the property, staff is not obligated to grant entry simply because it is requested. According to NAA guidance, administrative immigration warrants used by ICE or Border Patrol do not authorize entry into private areas of a property, including individual apartment homes. Only a judicial criminal warrant signed by a judge can authorize legal entry. Property staff have the right to review the warrant and document its details before taking any action. 

Similarly, resident records, applications, lease files, forwarding addresses, or other identifying information should never be released unless legally required. Property staff should request a subpoena or judicial warrant and consult legal counsel before providing any resident information or documentation.
