AAWNC Antitrust Statement

Declaration of Antitrust Compliance

The Apartment Association of Western North Carolina (AAWNC) and The Apartment Association for North Carolina (AANC) are committed to antitrust compliance and expect the same of its members. Members participating in AAWNC/AANC activities are expected to not act or fail to act in a manner that would violate antitrust laws or cause unreasonable restraint of trade. Federal and state antitrust and anticompetition laws are designed to protect and promote competition by prohibiting agreements, combinations, and conspiracies that unreasonably restrain competition. In an effort to facilitate collaboration among members, trade associations can unwittingly create opportunities for competitors to engage in anti-competitive behavior, and violations of antitrust laws can be punished with large financial penalties, as well as criminal penalties. Prohibited behavior includes, but is not limited to: discussion of any company’s confidential or proprietary information, discussion, agreements, or coordination, either explicit or implicit, regarding current or future pricing of particular products or services of a company, wages, forecasting the prices of goods or services, agreements not to compete with respect to any good or service, members should not be discussing customer accounts, agreeing with competitors not to deal with certain suppliers, or sharing of confidential or sensitive corporate information even if that information does not fit in any of the categories referenced above.

Membership Agreement in Antitrust Standards.

As a member of these associations and by participating in apartment association activities, you hereby acknowledge and agree to adhere strictly to all antitrust and anticompetition laws. You understand that these laws prohibit any actions, whether explicit or implicit, that could result in unreasonable restraint of trade. Therefore, you pledge to maintain confidentiality by refraining from disclosing any company's proprietary information, avoid discussions or agreements regarding prices or specific products/services, refrain from forecasting prices, and abstain from sharing any sensitive information deemed confidential by my company. You recognize that any violation of these guidelines could lead to legal repercussions, and thus, you commit to conducting yourself with integrity and in full compliance with all applicable laws and regulations.
